Contenuti su questa Applicazione

Salvo ove diversamente specificato o chiaramente riconoscibile, tutti i contenuti disponibili su questa Applicazione sono di proprietà di o forniti dal Titolare o dei/dai suoi licenzianti.

Il Titolare adotta la massima cura affinché il contenuto disponibile su questa Applicazione non violi la normativa applicabile o diritti di terze parti. Tuttavia, non sempre è possibile raggiungere tale risultato.
In tali casi, senza alcun pregiudizio ai diritti ed alle pretese legalmente esercitabili, gli Utenti sono pregati di indirizzare i relativi reclami ai recapiti specificati in questo documento.

Accesso a risorse esterne

Tramite questa Applicazione gli Utenti potrebbero avere accesso a risorse fornite da terzi. Gli Utenti riconoscono ed accettano che il Titolare non ha alcun controllo su tali risorse e che pertanto non risponde del loro contenuto e della loro disponibilità.

Le condizioni applicabili alle risorse fornite da terzi, ivi incluse quelle applicabili a eventuali concessioni di diritti su contenuti, sono determinate dagli stessi terzi e regolate nei relativi termini e condizioni o, in loro assenza, dalla legge.

Uso ammesso

Questa Applicazione ed il Servizio possono essere utilizzati solo per gli scopi per i quali sono offerti, secondo questi Termini ed ai sensi della legge applicabile.

È responsabilità esclusiva dell’Utente di far sì che l’uso di questa Applicazione e/o del Servizio non violi la legge, i regolamenti o i diritti di terzi.

Disposizioni comuni

Nessuna rinuncia implicita

Il mancato esercizio di diritti di legge o pretese derivanti da questi Termini da parte del Titolare non costituisce rinuncia agli stessi. Nessuna rinuncia può essere considerata definitiva in relazione ad uno specifico diritto o a qualsiasi altro diritto.

Interruzione del Servizio

Per garantire il miglior livello di servizio possibile, il Titolare si riserva di interrompere il Servizio per finalità di manutenzione, aggiornamenti di sistema o per qualsiasi altra modifica, dandone idonea notizia agli Utenti.

Nei limiti di legge, il Titolare si riserva di sospendere o cessare completamente l'attività del Servizio. In caso di cessazione dell'attività del Servizio, il Titolare si adopererà affinché gli Utenti possano estrarre i propri dati personali e le informazioni e rispetterà i diritti degli Utenti relativi all’utilizzo continuato del prodotto e/o al risarcimento, secondo le disposizioni di legge.

Inoltre, il Servizio potrebbe non essere disponibile per cause che si sottraggono al ragionevole controllo del Titolare, quali cause di forza maggiore (p. es. malfunzionamenti infrastrutturali, blackout etc.).

Rivendita del Servizio

Gli Utenti non sono autorizzati a riprodurre, duplicare, copiare, vendere, rivendere o sfruttare questa Applicazione o il Servizio in toto o in parte senza previo consenso scritto del Titolare, espresso direttamente o attraverso un legittimo programma di rivendite.

Proprietà intellettuale

Senza pregiudizio ad alcuna previsione più specifica contenuta nei Termini, i diritti di proprietà intellettuale ed industriale, quali ad esempio diritti d’autore, marchi, brevetti e modelli relativi a questa Applicazione sono detenuti in via esclusiva dal Titolare o dai suoi licenzianti e sono tutelati ai sensi della normativa e dei trattati internazionali applicabili alla proprietà intellettuale.

Tutti i marchi – denominativi o figurativi – ed ogni altro segno distintivo, ditta, marchio di servizio, illustrazione, immagine o logo che appaiono in collegamento con questa Applicazione sono e restano di esclusiva proprietà del Titolare o dei suoi licenzianti e sono tutelati ai sensi della normativa e dei trattati internazionali applicabili alla proprietà intellettuale.

Modifiche dei Termini

Il Titolare si riserva il diritto di modificare i Termini in ogni momento. In tal caso, il Titolare darà opportuna notizia delle modifiche agli Utenti.

Le modifiche avranno effetto nel rapporto con l’Utente solo a partire dal momento comunicato all'Utente.

L’utilizzo continuato del Servizio implica l’accettazione dell’Utente dei Termini aggiornati. Se l’Utente non desidera accettare le modifiche, deve cessare l’utilizzo del Servizio e può recedere dall'Accordo.

La versione precedente continua a disciplinare il rapporto fino all’accettazione delle modifiche da parte dell’Utente. Tale versione può essere richiesta al Titolare.

Cessione del contratto

Il Titolare si riserva il diritto di trasferire, cedere, disporre di, novare o appaltare singoli o tutti i diritti e le obbligazioni secondo questi Termini, avendo riguardo per gli interessi legittimi degli Utenti.

Si applicano le disposizioni relative alla modifica di questi Termini.

L’Utente non è autorizzato a cedere o trasferire i propri diritti e le proprie obbligazioni secondo i Termini senza il consenso scritto del Titolare.

Clausola di salvaguardia

Qualora alcuna delle disposizioni di questi Termini dovesse essere o divenire nulla o inefficace ai sensi della legge applicabile, la nullità o inefficacia di tale disposizione non provoca inefficacia delle restanti previsioni, che permangono pertanto valide ed efficaci.

If the customer is a consumer (i.e. a natural person who purchases the goods for purposes other than any entrepreneurial or professional activity carried out or does not purchase by indicating a VAT number in the order form), purchases made on the website www.le-gioie.it are governed by the Italian law on distance selling (Legislative Decree no. 206 of 6 September 2005). Le Gioie srl also complies with the obligations set forth in Legislative Decree no. 70 of 9 April 2003 (Implementation of Directive 2000/31/EC relating to particular legal aspects of information society services in the internal market with reference to electronic commerce).

The sale between Le Gioie and the customer must be considered concluded when the order sent by the customer, in compliance with the purchase procedure specifically indicated on the indicated website, reaches the address of the site itself. The order sent by the customer will be binding for Le Gioie srl only if the entire purchase procedure is completed regularly and correctly, without error messages from the site. By sending the purchase order, the customer acknowledges and declares that he has read all the information provided by the site during the online purchase procedure and fully accepts the general conditions of sale.

Purchase methods

The customer can only purchase the products present in the site catalog at the time of the order as described in the technical sheet. The order cannot be placed in relation to products that, although present in the site catalog, are indicated as unavailable. In any case, the products on the site are offered until they are available.

All products displayed on the site are intended to be available for immediate delivery, unless otherwise explicitly indicated. The sales prices displayed on the site www.le-gioie.it include VAT. Correct receipt of the order is confirmed by Le Gioie di Maria Rotonda Cerasuolo by means of a communication note sent by email to the email address indicated by the customer in the purchase procedure. The confirmation communication will include the order number identification, the date and time of the order, the indication of the products purchased, the price, the delivery costs and any cash on delivery, the data provided by the customer for invoicing and delivery, the payment method chosen by the customer and a summary of the general conditions of sale. The customer must immediately verify the content of the communication and undertakes to verify the accuracy of the data contained therein and to promptly communicate any errors and/or omissions. In the event of temporary out of stock or delay of a product, the customer will be promptly notified by email.

Payment terms

Each payment by the customer can be made exclusively through one of the methods indicated on the le-gioie.it website

Payment is possible via Paypal, by credit card and prepaid card. The amount of the order will be charged to the customer's Paypal account after confirmation of the order by Le Gioie. The product will be delivered after verification of the crediting of the purchase price to the Paypal account of Le Gioie di Maria Rotonda Cerasuolo. Any refunds to the customer will always be made by Le Gioie di Maria Rotonda Cerasuolo to the Paypal account. For each transaction, a confirmation will be sent by email from Paypal.

Advance bank transfer

In case of payment by bank transfer, the execution of the order delivery will be kept suspended until the amount due is credited to Le Gioie's bank account. The bank transfer must be made by the customer within three working days of receiving the email confirming receipt of the order and the customer must provide proof of the order by sending a copy to Le Gioie di Maria Rotonda Cerasuolo by email to info@le-gioie.it.

The crediting of the amount paid to the Le Gioie account must occur within eight working days of receiving the email confirming receipt of the order. If one of the above terms expires without result, the order will be automatically cancelled and will not be processed. The reason for the bank transfer must include: I) name and surname, company name, name of the person placing the order; II) the order reference number; III) the date of execution of the order.

Cash on delivery

Payment by cash on delivery will be subject to the following conditions:

Payment must be made exclusively with banknotes (bank checks or cashier's checks will not be accepted) directly to the courier upon delivery; Supplement of € 4.90 on the total order.

Delivery methods and costs

Le Gioie srl will deliver the selected and purchased products via express courier to the address provided by the customer at the time of ordering. Orders will be processed as soon as received. Le Gioie srl undertakes to deliver the products as quickly as possible. The total amount of the costs will be visible before proceeding with the purchase confirmation. The shipped goods will be checked and delivered to the courier intact and without defects.

Shipping Italy: Transport in Italy and Europe is entrusted to the express courier of maximum notoriety and reliability. Delivery in Italy takes place within 24/48 hours, the times indicated above are absolutely indicative and may vary during holiday periods and/or depending on the place of destination. In any case we are not responsible for any delays due to the courier. For transport to European countries, delivery times vary from 2 to 5 working days depending on the destination.

To ensure accurate and safe delivery, please indicate the destination address as precisely as possible, complete with useful information, such as Scale, Interior, Intercom, etc.

Associated with each order, there will be and will be communicated via email confirming the departure of the package from our warehouse, a shipping code consisting of an identification number with which the package can be tracked on the courier's website.

Failure to deliver due to the recipient's absence: In the event that the recipient of the shipment is not available, the courier will leave a notice at the first passage and will make a second passage the following day. In the event that the recipient is not available again, the goods will be put into storage at the second passage.

The storage service consists of the storage of shipments that have not been delivered for reasons beyond the control of the courier. In the event of failure to deliver, the goods are placed in special supervised areas with limited access. The service includes sending information about the stock and requesting the return of shipments. The goods are returned to the sender if there are no new instructions within 10 working days from the date of opening the stock. All costs relating to stock and deliveries will be charged directly to the recipient.

The issuing of the invoice is not mandatory unless requested by the customer within and no later than the execution times of the operations as indicated in art. 22 of the Presidential Decree of 26/10/1972 n. 633. By sending the order to Le Gioie the customer agrees to receive the invoice/receipt in electronic format. The customer can receive the invoice/receipt in paper format by making a request to Le Gioie.

Right of withdrawal

The customer has the right to withdraw without any penalty and without specifying the reason within 14 (fourteen) working days from the day of receipt of the products, by sending a communication via email to info@le-gioie.it

The communication referred to in the previous point must specify the intention to withdraw from the purchase and the product or products for which the right of withdrawal is to be exercised, attaching a copy of the receipt/tax invoice. Subsequently, the customer must return the product in the original packaging at his/her own expense to Le Gioie srl, Via Vittorio Veneto 56, Parete (CE) - 81030. The goods must be returned intact, in the original packaging, complete in all its parts and accompanied by the attached tax documentation.

Without prejudice to the possibility of verifying compliance with the above, Le Gioie will refund the amount of the products subject to withdrawal on the payment instrument used for payment as soon as possible and in any case within a maximum of 14 days from the date on which it became aware of the exercise of the right of withdrawal. Naturally, Le Gioie srl has the right not to accept the return of products altered in their original condition or damaged.

If the recipient of the products indicated in the order is different from the person who made the payment for such products, the amount paid for the returned items will be refunded by Le Gioie srl to the person who made the payment. In the event of exercise of the right of withdrawal, Le Gioie srl will not be responsible for the transport costs for the return nor for any loss or damage to the products attributable to third parties.

Liability

Le Gioie srl assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the Internet network, in the event that it is unable to execute the order within the timeframes set out in the contract. Le Gioie srl will not be liable for damages, losses and costs incurred by the customer due to failure to execute the contract for reasons not attributable to him, and unless they depend on an act or omission by Le Gioie srl, the customer being entitled only to a full refund of the price paid and any additional charges incurred.

Le Gioie srl cannot be held liable for the information, data and any technical or other inaccuracies contained in the site, if they have been communicated by third parties and have been verified by Le Gioie srl according to the criteria of ordinary diligence. Le Gioie assumes no responsibility for any fraudulent or illicit use that may be made by third parties of credit cards, checks and other means of payment, at the time of payment for the products purchased, if it can demonstrate that it has adopted all possible precautions based on the best science and experience of the moment and based on ordinary diligence.

Privacy and Processing of Personal Data

The website www.le-gioie.it is accessible and navigable anonymously. All products on the pages can be freely consulted, a similar operating method applies to the insertion of products in the cart for proof of purchase and verification of shipping costs.

It will be possible to subscribe to the Newsletter to be periodically informed about promotions and news. The data provided are subject to compliance with the law on "Protection of individuals and other subjects with respect to the processing of personal data" (Legislative Decree 30.6.2003 n. 196), known as the Privacy Law. Personal data are processed mainly in electronic and paper form, within the scope of normal business activity for:

Purposes strictly connected and instrumental to the management of relationships with the compilation (internal statistics, feedback, preliminary acquisition of information aimed at the conclusion of a contract or the provision of a service, etc.); purposes connected to the obligations set out in current tax legislation; if expressly permitted for promotional purposes or for sending editorial material.

Legal guarantee of conformity

The products sold on le-gioie.it are covered by the legal guarantee of conformity (two years) pursuant to articles 128 and following of the Consumer Code.

Pursuant to art. 132 of the Consumer Code, the seller is liable when the lack of conformity occurs within two years of delivery of the goods. The consumer loses the rights provided for in the matter of legal guarantee if he does not report the lack of conformity to the seller within two months of the date on which he discovered the defect.

Jurisdiction and Disputes

Consumers resident in Europe are informed that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by the European Consumer to resolve in a non-judicial manner any dispute relating to contracts for the sale of goods and services stipulated online and/or deriving from them.
